It is the responsibility of the debtor to advise the offices of both the Trustee and debtor attorney as to any changes in address, phone number, place of employment, marital status, and any other matter affecting your ability to perform under the plan.

PAYOFF FOR A CASE

The actual payoff in a case is all of the unpaid claims plus trustee commission if the case is to be paid off prior to 60 months for above median income cases. For below median income cases, the actual payoff is the unpaid claims balances plus trustee commission if requested prior to month 36.  Debtors must contact their attorney and their attorney is to contact the trustee concerning receiving a payoff in the case. Remember, no money may be borrowed during the case without court authority.

TAX REFUNDS AND TAX RETURNS

You must provide the Trustee with a copy of your federal tax return every year of your case.  Deliver the tax return to your attorney’s office who will email it to the Trustee’s office.

All tax refunds during your entire case must be turned over to the Trustee.  Failure to turn the refund over to the Trustee immediately will result in your case being dismissed and will also result in a limitation of your ability to file future bankruptcy cases.
